Mutari Fitness ("Mutari Fitness," "we," "us," or "our") respects your privacy. This Privacy Policy explains how we collect, use, disclose, store, and protect information in connection with the Mutari Fitness website, mobile application, platform, software, fitness and wellness tools, workout programs, nutrition features, artificial intelligence features, communications tools, subscription services, support services, and related services (collectively, the "Platform").

This Privacy Policy applies to visitors, registered Users, subscribers, and other persons who access or use the Platform. By accessing or using the Platform, you acknowledge this Privacy Policy and our Terms of Use. Capitalized terms not defined in this Privacy Policy have the meanings given to them in the Terms of Use.

Mutari Fitness does not knowingly permit persons under eighteen (18) years of age to create accounts or use the Platform.

• AI Features and automated tools;

• customer support and feedback;
• cookies and similar technologies;
• analytics, monitoring, and security tools; and
• third-party service providers.

3. How We Use Information

• create, maintain, verify, and secure accounts;
• provide, operate, improve, and support the Platform;
• provide workouts, fitness programs, wellness information, and general nutrition information;
• personalize Content, workouts, recommendations, and Platform functionality;
• calculate or estimate wellness metrics, including calorie or macronutrient targets, total daily energy expenditure, body composition, and similar fitness or wellness metrics;
• generate AI-powered workout recommendations, meal suggestions, coaching insights, and other requested AI-assisted Content;
• maintain workout, activity, nutrition, and progress information;
• track progress and display historical trends;
• award achievements or milestones;
• allow Users to track goals, activity, and performance;
• provide Trainer, coaching, or communication features;
• process subscriptions, payments, refunds, and related transactions;
• provide customer support;
• send account, subscription, security, billing, legal, and service-related communications;
• send reminders, notices, or other communications requested or permitted by Users;
• monitor Platform security and prevent fraud, misuse, unauthorized access, or abuse;
• enforce our Terms of Use and other Platform policies;
• troubleshoot errors and improve Platform performance;
• analyze Platform usage, features, and product needs;
• develop, test, maintain, and improve Platform functionality;
• comply with legal, tax, accounting, regulatory, and dispute-resolution obligations;
• protect the rights, property, safety, or security of Mutari Fitness, our Users, service providers, or others;
• use aggregated, anonymized, or de-identified information for analytics, reporting, research, product development, business, or operational purposes; and
• carry out other purposes disclosed when information is collected or with your consent.

We do not use information collected through the Platform to provide medical diagnosis or treatment.

4. Trainers, Coaching, and Platform Features

Certain Platform features may allow information to be shared with or made available to Trainers, coaches, contractors, or AI features to provide fitness, wellness, educational, or related services through the Platform.

Depending on the functionality you use, information may be shared that is reasonably necessary to provide the requested feature or service, which may include:

• your name and profile information;
• fitness goals;
• exercise preferences;
• workout history;
• activity and progress information;
• information you voluntarily communicate;
• nutrition or wellness preferences;
• User Content; and
• other information relevant to the requested feature.

Trainers, AI agents and other authorized persons may use information made available through the Platform for purposes connected with providing Platform services, communicating with Users, administering workouts or programs, or otherwise performing authorized functions.

Mutari Fitness may restrict access to information based on role, feature, authorization, or operational need.

Mutari Fitness does not sell, rent, or trade personal information.

Mutari Fitness may send transactional, operational, account, subscription, security, and service-related communications, including:

You may not be able to opt out of transactional, legal, security, billing, account, or other communications necessary to provide the Platform or administer your account.

We may use cookies, local storage, software development kits, log files, analytics tools, and similar technologies to operate, secure, monitor, analyze, and improve the Platform.

These technologies may help us:

Mutari Fitness does not currently use advertising cookies or cross-site tracking technologies to follow your activity across unrelated websites or applications.

You may be able to adjust browser or device settings to reject, clear, or restrict certain cookies, local storage, or similar technologies. Some Platform features may not function properly when these technologies are disabled.

8. Artificial Intelligence and Automated Processing

Mutari Fitness may use artificial intelligence, machine learning, automated recommendation systems, personalization technologies, conversational tools, or similar technologies ("AI Features") to provide and support certain Platform functionality.

AI Features may help us:

• generate workout suggestions or programs;
• provide general fitness, wellness, or nutrition information;
• generate meal suggestions;
• provide coaching insights;
• personalize Content;
• respond to questions;
• support chatbot or conversational functionality;
• analyze fitness, activity, progress, or nutrition information;
• organize or summarize information;
• recommend Platform features or Content;
• support customer service;
• identify errors or improve functionality; and
• develop and maintain Platform features.

AI Features are optional and may process information when you intentionally choose to use or interact with an AI-powered feature.

Depending on the feature, relevant portions of your account, fitness, activity, nutrition, wellness, preference, progress, or other information may be processed to generate or personalize the requested response.

Mutari Fitness uses technology and application infrastructure providers to provide and support AI Features. When you use an AI-powered feature, information relevant to your request may be processed through that infrastructure and, where applicable, by underlying artificial intelligence or language-model providers used to generate or support the requested functionality.

Such information may include prompts, profile information, fitness or nutrition information, workout history, preferences, and other information reasonably necessary to provide or personalize the applicable feature.

If you do not use an AI-powered feature, Mutari Fitness does not transmit your information to AI providers for the purpose of generating AI recommendations for you.

AI-related information may include:

• prompts;
• questions;
• instructions;
• information from your profile used to personalize a response;
• workout, activity, nutrition, or progress information relevant to the requested feature;
• AI-generated or AI-assisted outputs;
• feedback regarding AI outputs; and
• related usage and technical information.

We may retain AI interactions for as long as reasonably necessary to provide requested functionality, maintain security and reliability, investigate fraud or misuse, troubleshoot technical issues, enforce Platform policies, comply with legal obligations, and otherwise operate the Platform as described in this Privacy Policy.

Complete payment card information and other complete payment credentials are not processed through AI Features.

For Users in the European Economic Area ("EEA"), AI Features may involve automated processing or profiling to personalize workouts, nutrition information, recommendations, or other Platform Content. Unless otherwise disclosed, Mutari Fitness does not use AI Features to make decisions based solely on automated processing that produce legal effects concerning you or similarly significantly affect you.

If Mutari Fitness introduces automated decision-making that falls within Article 22 of the GDPR, we will provide any additional disclosures and safeguards required by applicable law, including information regarding the nature and consequences of that processing and applicable rights.

AI Features may change as the Platform evolves. We will update this Privacy Policy where required if changes materially affect how we collect, use, or disclose personal information.

9. Fitness, Wellness, and Consumer Health Information

Certain information collected through the Platform may relate to your physical condition, activity, fitness, nutrition, wellness, body measurements, or other health-related characteristics.

• calculate or estimate fitness and wellness metrics;
• provide or personalize workouts and recommendations;

• provide AI Features;
• connect with devices or services you authorize;
• support Trainer or coaching functionality;
• operate, maintain, secure, and improve the Platform; and
• comply with applicable law.

For Users in the EEA, certain fitness, wellness, physiological, allergy, heart-rate, body-composition, or other health-related information may constitute "data concerning health" or other special categories of personal data under the GDPR. To the extent Mutari Fitness processes such information as special-category personal data under the GDPR, we will process it only where an applicable condition under Article 9 of the GDPR permits such processing. Where we rely on consent, we will obtain your explicit consent for the applicable processing.

You may withdraw consent at any time where processing relies on your consent. Withdrawal does not affect the lawfulness of processing conducted before withdrawal. Certain optional features may no longer function or may provide less personalized functionality if you withdraw consent or choose not to provide information needed for those features.

Where applicable law requires consent for particular collection, use, or disclosure of consumer health information, we will request that consent as required.

Where applicable law grants rights relating specifically to consumer health information, including rights to access, correct, delete, or withdraw certain consent, we will honor verified requests as required by law.

Mutari Fitness does not treat fitness or wellness information submitted through the Platform as a substitute for a medical record maintained by a healthcare provider.

If your subscription ends, access to paid or premium functionality may end according to the applicable subscription terms. Ending a subscription does not necessarily delete your account or information associated with it.

Account deletion or disablement may not result in immediate deletion of all information. We may retain information where reasonably necessary or legally permitted for transaction records, fraud prevention, security, dispute resolution, legal compliance, accounting, backup systems, or other legitimate purposes.

Aggregated or de-identified information that no longer reasonably identifies you may be retained for analytics, reporting, research, product development, and other legitimate purposes.

Where applicable law requires deletion of particular information, including certain consumer health information, we will process verified requests as required by law.

We may deny or limit a request where applicable law permits or requires us to retain or continue processing information, including for security, fraud prevention, transaction records, legal compliance, accounting, dispute resolution, or other legally permitted purposes.

Where applicable law grants additional privacy rights, we will respond to verified requests as required.

Mutari Fitness uses commercially reasonable administrative, technical, and organizational safeguards designed to protect information from unauthorized access, disclosure, alteration, misuse, loss, or destruction.

These safeguards may include access controls, authentication measures, encryption, secure communications, monitoring, vendor safeguards, internal access limitations, backup practices, and other security measures appropriate to the nature of the Platform and information involved.

No security system guarantees absolute protection. We cannot guarantee that unauthorized persons will never access, disclose, alter, misuse, or destroy information.

If a security incident occurs, Mutari Fitness will provide notices to affected persons or governmental authorities when required by applicable law.

Mutari Fitness operates primarily in the United States.
